 - WE ENCOURAGE YOUR COMMENTS -

Under the Corps' Regulatory Program, a public notice is the primary method for advising all interested parties of a proposed activity for which a permit is sought. Public notices are also published to inform the public about new or proposed regulations, policies, guidance or permit procedures.

We are requesting public comments on many Public Notices (PNs) concurrently; please pay careful attention to the file number and the comments Due Date.

Email comments are preferred.  To submit comments in writing, send them to the attention of the Project Manager listed in the Public Notice title block.  All comments should reference the PN file number and be submitted by the Response Required Date on the PN.

The Public Notices are in pdf format. To read the files you may need to download and install Adobe Acrobat Reader or another comparable program

SPK 2016-00149, Decision to Accept and Expend Funds - Division of Environmental Services WRDA

Published Aug. 16, 2017

SUBJECT: The purpose of this Public Notice is to inform the general public that the District Commander of the Sacramento District, U.S. Army Corps of Engineers (“Corps”) has decided to accept funds contributed by the California Department of Water Resources in order to expedite processing of their permit applications which would implement the projects required by the United States Fish and Wildlife Service's 2008 Delta Smelt Biological Opinion and the National Marine Fisheries Service's 2009 Biological Opinion and Conference Opinion on the long-term operation of the Central Valley Project and the State Water Project, subject to the limitations specified below.

A series of procedural safeguards has been adopted to ensure that use of the funds will not impact impartial decision-making. These include:

a. All final permit decisions where these funds are used must be reviewed at least by one level above the decision maker, unless the decision maker is the District Commander. For example, if the decision maker is the California Delta Section Chief, then the reviewer would be the Regulatory Division Chief.

b. All final permit decisions where these funds are used will be made available on Regulatory HQ ORM2 Public Portal page.

c. The Corps will not eliminate any procedures or decisions that would otherwise be required for that type of project and permit application under consideration.

d. The Corps will comply with all applicable laws and regulations.

e. Funds will only be expended to provide priority review of the participating non-federal entity’s permit applications and processes.

Information concerning WRDA, including documents referenced in this notice, may be found on our Headquarters website. If you have any questions or need additional information please contact Michael Nepstad, 1325 J Street, Sacramento, California 95814-2922. Alternatively, comments can be sent electronically to Michael.g.nepstad@usace.army.mil.
