PINOLE CREEK
CONTINUING AUTHORITY, SECTION 1135
PROJECT LOCATION AND DESCRIPTION
The study area is located within the cities of Pinole and Hercules, Contra Costa County, California. It is bordered by Highway 80 on the east and San Francisco Bay on the west. This Section 1135 project would modify an existing flood-control project, the Pinole Creek Local Flood Protection Project. Prior to construction of that project, downtown Pinole was subject to periodic flooding when water overflowed the banks of the creek as a result of high flow volumes. This project converted approximately 1.5 miles of the lowest reach of Pinole Creek to an earthen trapezoidal flood control channel to provide flood protection for the downtown, eliminating an estimated 95% of the riparian community within the project area. This proposed project would modify approximately 25 acres of open water, marsh, riparian, and native upland habitat along 6,000 feet of lower Pinole Creek to restore the Creek to a more natural state without affecting flood-control protection. It also provide vital habitat for steelhead trout, a member of the Central Coast Environmentally Significant Unit in the San Francisco Bay region.

- This study will be closed out due to non-Federal sponsor inability to cost share the feasibility study per HQ 27 Aug 2013 guidance.

ISSUES AND OTHER INFORMATION
- The Contra Costa County Flood Control District is the Non-Federal Sponsor (NFS).
- This project did not receive funds from the American Recovery and Reinvestment Act of 2009 (ARRA), Title IV, Pub. L. No. 111-5, 123 Stat. 115, Feb. 17, 2009.
- HQ provided new guidance on 27 Aug 2013, “Continuing Authority Program (CAP) process improvements #2 – Changes to procedures for CAP studies and design”. This guidance requires the non-Federal sponsor for all “Grandfathered Projects” to cost share in the feasibility study phase. As a result of this guidance, the non-Federal sponsor had responded by e-mail in Feb 2014 that they are not able to cost share in the feasibility study. Their formal decline to the feasibility study will be sent to us soon.
