USACE issues permit authorizing California wildfire mitigation activities in waters of the United States

The U.S. Army Corps of Engineers has issued Regional General Permit (RGP) 10, authorizing activities associated with wildfire mitigation that may involve discharge of dredged or fill material into waters of the United States and/or work in or affecting navigable waters of the United States, including wetlands, within the State of California.  

The issuance of RGP10 authorizes activities that fall within the following seven categories: (1) Utility Lines and Associated Infrastructure; (2) Access Areas; (3) Temporary Dewatering; (4) Sediment and Debris Management; (5) Damaged Uplands; (6) Fire/Fuel Breaks; and (7) Development Structures.

Activities must be associated with wildfire mitigation, including wildfire prevention, protection, response, clean-up, and recovery from wildfires, which is of critical concern due to the State of California’s susceptibility to wildfires. 

To address this issue, USACE’s Los Angeles, Sacramento, and San Francisco Districts established RGP10 to provide a streamlined permitting process for wildfire prevention, response, and recovery while protecting the nation’s aquatic resources,
