Under the Corps' Regulatory Program, a public notice is the primary method for advising all interested parties of a proposed activity for which a permit is sought. Public notices are also published to inform the public about new or proposed regulations, policies, guidance or permit procedures.

We are requesting public comments on many Public Notices (PNs) concurrently; please pay careful attention to the file number and the comments Due Date.

Email comments are preferred.  To submit comments in writing, send them to the attention of the Project Manager listed in the Public Notice title block.  All comments should reference the PN file number and be submitted by the Response Required Date on the PN.

Following, an initial public notice circulated on March 9, 2020, this Special Public Notice announces that the District Commander of the San Francisco District of the U.S. Army Corps of Engineers (“Corps”) has decided to accept and expend funds contributed by the California High Speed Rail Authority (Authority). The San Francisco District would allocate funds internally in order to expedite processing of the Authority’s Section 408 permission requests in accordance with 33 U.S.C. 4081 (Section 408). Though the Authority would receive more expeditious reviews of their permission requests, procedural and substantive requirements of the DA permit application review process remain unchanged. The decision to accept funds does not constitute any endorsement or implied consent of the Authority’s proposed project(s); rather, it will enable Corps personnel to devote the attention required to these applications, in both a timelier and more thorough manner, benefiting both the Authority and the public.

Procedures for reviewing requests for Section 408 permission are contained in Engineer Circular (EC) 1165-2-220. EC 1165-2-220 and additional information about Section 408 can be viewed at the San Francisco District’s webpage at: https://www.usace.army.mil/Missions/Civil-Works/Section408/
