Mitigation Bank BEI, Sale Agreements, and Checklists

The Sacramento, San Francisco, and Los Angeles Districts of the U.S. Army Corps of Engineers (USACE), along with the U.S. Fish and Wildlife Service (USFWS), the California Department of Fish and Wildlife (CDFW), the California Resources Agency, the National Marine Fisheries Service (NMFS), the United States Environmental Protection Agency (EPA), the State Water Resources Control Board (State Water Board), and the Natural Resources Conservation Service (NRCS) as potential participants in Interagency Review Teams (IRT) have updated the standard Mitigation Bank Enabling Instrument (BEI) template, Bank Proposal Guidelines, Bank Proposal Checklists, and developed Sales Agreement Templates, for use with mitigation banks that are established within the State of California. This notice is to inform interested parties of the availability of the completed templates, checklists, and guidance.

SPN-2021-00065 Santa Cruz Harbor Routine Maintenance

The Santa Cruz Port District (Port District) has applied to the U.S. Army Corps of Engineers (USACE), San Francisco District, for a Department of the Army Permit to develop a Regional General Permit (RGP) with the Army Corps of Engineers (Corps) for routine maintenance activities in the Santa Cruz Harbor (project). The proposed RGP would authorize routine maintenance activities occurring at the Port District-maintained facilities over a five-year period. The RGP would replace the Nationwide Permit Program as the primary permitting instrument for the Port District’s routine maintenance activities with no more than minimal adverse effects on waters of the U.S. Similar to the Nationwide Permit Program, prior to conducting any given maintenance activity regulated by USACE, the Port District would be required to receive written verification from USACE that the activity is authorized under the RGP.

SPN-2011-00065 Hunter's Point Natural Gas Well Drilling Project

Sunset Exploration has applied to the U.S. Army Corps of Engineers (USACE), San Francisco District, for a Department of the Army Permit to discharge fill into jurisdictional wetlands for Phase 1 and Phase 2 of a natural gas well drilling project. Phase 1 would require 1.05 acres of fill in jurisdictional wetlands to explore the potential of natural gas production in a new well (Phase 1). Phase 2 of the project would be development of the well for production resulting in an additional 0.31 acres of fill for a total of 3,800 cubic yards of fill impacts to 1.36 acres of jurisdictional wetlands from both Phase 1 and Phase 2 of the project.

Final 2021 Nationwide Permit Regional Conditions For The State Of California

On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published the notice in the Federal Register announcing the reissuance of 12 existing nationwide permits (NWPs), general conditions, and definitions with some modifications. The Corps also issued four new NWPs, one new general condition, and five new definitions. These 16 NWPs will go into effect on March 15, 2021, and will expire on March 14, 2026.

SPN-2020-00346 Availability of Prospectus: Kelly Farm Mitigation Bank

The City of Santa Rosa has submitted a Prospectus to the U.S. Army Corps of Engineers (Corps), and other members of the Interagency Review Team (IRT) for the establishment of the Kelly Farm Mitigation Bank. If authorized, this mitigation bank would receive money from individuals or entities (“project proponent”) receiving Corps authorization under Section 404 of the Clean Water Act of 1972, when appropriate, to provide compensatory mitigation credit as part of Section 404 permits or enforcement actions within the proposed service area. Additionally, the proposed mitigation bank may be utilized to offset unavoidable impacts to waters of the State that are regulated by the Regional Water Quality Control Board under Section 401 of the Clean Water Act or Section 13260 of the Porter-Cologne Act.

On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 2744) announcing the reissuance of 12 existing nationwide permits (NWPs) and four new NWPs, as well as the reissuance of NWP general conditions and definitions with some modifications. SPN-2019-00437 Oyster Cove Marina – Maintenance Dredging

On November 2, 2020, the U.S. Army Corps of Engineers, San Francisco District, issued an emergency permit to Pacific Gas & Electric Company to replace three electrical transmission towers at risk of failure. This Department of the Army permit was issued under special processing procedures for emergency situations pursuant to 33 C.F.R. § 325.2(e)(4) and the South Pacific Division Regulatory Program Emergency Procedures, as well as the provisions of Section 404 of the Clean Water Act of 1972, as amended (33 U.S.C. § 1344 et seq.), and Section 10 of the Rivers and Harbors Act of 1899, as amended (33 U.S.C. § 403 et seq.).
