National Wetland Plant List for 2020

SPN-2011-00065 Hunter's Point Natural Gas Well Drilling Project

Expiration date: 4/2/2021

Sunset Exploration has applied to the U.S. Army Corps of Engineers (USACE), San Francisco District, for a Department of the Army Permit to discharge fill into jurisdictional wetlands for Phase 1 and Phase 2 of a natural gas well drilling project. Phase 1 would require 1.05 acres of fill in jurisdictional wetlands to explore the potential of natural gas production in a new well (Phase 1). Phase 2 of the project would be development of the well for production resulting in an additional 0.31 acres of fill for a total of 3,800 cubic yards of fill impacts to 1.36 acres of jurisdictional wetlands from both Phase 1 and Phase 2 of the project.

SPN-2002-273010 Vacation Beach Summer Crossing

Sonoma County Department of Transportation and Public Works (DTPW) has applied to the U.S. Army Corps of Engineers (USACE), San Francisco District, for a Department of the Army Permit to continue the installation and removal of a seasonal road crossing on the lower reach of the Russian River, via an extension of Vacation Beach Avenue at Vacation Beach, near the Town of Guerneville, in Sonoma County, California. The road crossing was previously authorized under Department of the Army Permit No. 273010N that expired on December 31, 2020.

Final 2021 Nationwide Permit Regional Conditions For The State Of California

On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published the notice in the Federal Register announcing the reissuance of 12 existing nationwide permits (NWPs), general conditions, and definitions with some modifications. The Corps also issued four new NWPs, one new general condition, and five new definitions. These 16 NWPs will go into effect on March 15, 2021, and will expire on March 14, 2026.

SPN-2020-00346 Availability of Prospectus: Kelly Farm Mitigation Bank

The City of Santa Rosa has submitted a Prospectus to the U.S. Army Corps of Engineers (Corps), and other members of the Interagency Review Team (IRT) for the establishment of the Kelly Farm Mitigation Bank. If authorized, this mitigation bank would receive money from individuals or entities (“project proponent”) receiving Corps authorization under Section 404 of the Clean Water Act of 1972, when appropriate, to provide compensatory mitigation credit as part of Section 404 permits or enforcement actions within the proposed service area. Additionally, the proposed mitigation bank may be utilized to offset unavoidable impacts to waters of the State that are regulated by the Regional Water Quality Control Board under Section 401 of the Clean Water Act or Section 13260 of the Porter-Cologne Act.

On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 2744) announcing the reissuance of 12 existing nationwide permits (NWPs) and four new NWPs, as well as the reissuance of NWP general conditions and definitions with some modifications. This Department of the Army permit was issued under special processing procedures for emergency situations pursuant to 33 C.F.R. § 325.2(e)(4) and the South Pacific Division Regulatory Program Emergency Procedures, as well as the provisions of Section 404 of the Clean Water Act of 1972, as amended (33 U.S.C. § 1344 et seq.), and Section 10 of the Rivers and Harbors Act of 1899, as amended (33 U.S.C. § 403 et seq.).

SPN-2013-00327 Notice Of Availability For The FERC Order Compliance Project

Valley Water has applied to the U.S. Army Corps of Engineers (USACE), San Francisco District, for a Department of the Army Permit to discharge fill into jurisdictional waters of the United State associated with the construction of infrastructure for public safety and environmental protection elements needed in order to meet the Federal Energy Regulatory Commissions (FERC) Order issued on February 20, 2020. In response to the order issued by FERC Valley Water has developed the FERC Order Compliance Plan (FOCP) to address the issues related to safety at the Anderson Dam. The Interim risk reduction Measures (IRRMs) developed within the FOCP includes the Anderson Dam dewatering to a water surface elevation of 488 feet beginning by October 1, 2020, the Anderson Dam Tunnel, Reservoir Bank and Rim Stability Improvements, Cross Valley Pipeline Extension, the Coyote Percolation Dam Replacement, and the implementation of the Coyote Creek flood management measures, all located in the City of Morgan Hill and San Jose, within Santa Clara County, California. The Corps has reviewed the application and determined that the dewatering of the reservoir is not a regulated activity and the Coyote Creek flood management measures will not take place within jurisdictional areas.
